The National Land Transport Agency (ANTT) has reported that it will adjust the freight rate because of the variation in the price of diesel, says Agência Brasil.
According to ANTT, Law 13,703, of 2018, provides that a new table with minimum freight must be published when there is a fluctuation of more than 10% in the price of diesel in the domestic market. The law instituted the National Policy of Minimum Floors of Road Transport of Loads.
Since last Friday (31), the average price of diesel in Petrobras refineries has increased by 13.03%. With the increase, the price went from R $ 2.0316 to R $ 2.2964. It is the first adjustment since June, when, in agreement with the strike truckers, the government froze the price of the product at the refineries at R $ 2.0316 per liter.
The executive secretary of the Ministry of Mines and Energy, Márcio Felix, said that the government should not act to contain the rise in the price of diesel, due to lack of resources for a new attempt to stabilize the values.
Last week, the Federal Supreme Court (STF) held a public hearing on the freight table, which was challenged in Court. Representatives of the productive sector and truck drivers, who presented arguments against and in favor of the minimum freight rate, created in May by the government via a provisional measure and converted into law by Congress this month were heard. After the public hearing, Minister Luiz Fux stated that he will take the three direct actions of unconstitutionality (ADIs) on the matter for analysis directly in the plenary of the Court.
On July 29, ANTT also warned that non-compliance with the minimum freight charge may imply a fine. In the note, ANTT recalls that a resolution dealing with minimum freight is in force “until all the necessary administrative procedures for the publication of a new standard dealing with minimum freight floors have been completed.”
