The National Agency of Land Transport (ANTT) published last Friday (09) the definition of the values of fines that will be applied to those who do not meet the minimum prices of the road freight tariff, reports Agência Brasil. The agency was already monitoring compliance with the minimum freight floor. But the assessments did not generate a fine because the punitive regulations were lacking.

According to the resolution published in the Federal Official Gazette, the amounts will be applied in four different situations, varying from the minimum value of R $ 550 and can reach a maximum of R $ 10.5 thousand.
By the regulation, the company that contracts the road transport service of cargo below the minimum floor established by the regulatory agency will have specific punishment. In this case, the fine will be twice the difference between the amount paid and the floor due, limited to the minimum of R $ 550.00 and a maximum of R $ 10,500.00.
For the carrier that carries out the service of road transport of cargo in a value lower than the minimum level of freight defined by ANTT, a fine of R $ 550 will be imposed. The resolution also says that those responsible for announcements of offers for contracting road transport of load less than the minimum floor will be subject to a fine of R $ 4,975.
The text further states that contractors, carriers, advertisers or other market agents who prevent, obstruct or in any way obstruct access to the information and documents requested by the inspection to verify the regularity of the payment of the freight amount may to suffer a fine of R $ 5 thousand.
“ANTT may use the document that characterizes the transport operation, related tax documents and the information used in the generation of the Identification Code of the Transportation Operation to prove the violation foreseen in this article,” says the resolution.
The constitutionality of the freight table, the result of an agreement between truck drivers and the government of Michel Temer to end the road transport shutdown in the country, is being questioned in the Federal Supreme Court.
After a public hearing on the freight table in August, Minister Luiz Fux, rapporteur of the case, said that he will not decide alone on the issue and that he will take the three direct actions of unconstitutionality (ADIs) on the matter for analysis directly in plenary of the Court.
