STF suspends fines for non-compliance with the freight table

The Federal Supreme Court (STF) suspended the application of fines for possible noncompliance with the freight rate. The decision was published on Thursday (06) by the rapporteur who judges the action in the supreme court, the minister Luiz Fux. The measure meets a request made by the Confederation of Agriculture and Livestock of Brazil (CNA), which since the establishment of the tabulation, claims that the measure is unconstitutional.

According to information from the CNA, with the decision of the Supreme Court, the National Land Transportation Agency (ANTT) is prohibited from applying penalties to those who do not comply with the table, which reached R $ 10.5 thousand. The entity had requested the suspension of the fines and filed a Direct Action of Unconstitutionality (ADI) to request the end of the measure.

“This decision brings legal certainty to the agricultural sector because it does not penalize the company because we consider it unconstitutional,” said CNA’s Legal Adviser, Rudy Ferraz, in a note.

In the document, Minister Luiz Fux cites the CNA’s lawsuit and the Direct Action of Unconstitutionality No. 5,959, filed by the Entity. The decision is provisional and it is worth until the STF plenary judge the constitutionality of the freight tariff, which has not yet a date.
