Toll in freight prices should be optional, says Arnaldo Jardim

The former secretary of Agriculture of São Paulo and federal deputy Arnaldo Jardim, (PPS-SP)  presented amendments to the text of Provisional Measure (MP) 832/2018 which deals  Policy of Minimum Prices of Road Transport of Loads.

According to information from the Parliamentary Front of Agriculture (FPA), the main amendment presented by Jardim proposes that the freight tariff is a reference, that is, its employment is optional and that serves as a reference for which carriers in general cover this service.

He also called for “the process of fixing these prices to be attended by representatives of freight transport cooperatives, transport company unions and freight forwarders and representatives of freight contractors” and “that the considered, preferably, in the costs of diesel oil and toll “.

According to Jardim, the MP runs a serious risk of being considered unconstitutional, since it violates free initiative and free competition, basic principles of the economic order of the Constitution of 1988. “The value of the tariff in the transportation of freight by road, unlike the transportation of passengers, is determined by market laws, that is, by supply and demand. It is a commercial relationship, practiced between the customer (shipper) and the service provider (carrier, whether company or autonomous) “, says the parliamentarian.

For him, despite the merit of the government’s goal of mitigating failures in the road freight transport market, the edition of the measure also damages the country’s economy. “As it was put, the MP puts the Brazilian economy in a series of risks, such as the increase in transportation costs and inflation; the loss of competitiveness of exports and discouragement of production; and the creation of uncertainties in transportation contracts and labor liabilities, “says Jardim.
