The former president of the Parliamentary Agricultural and Livestock Front (FPA), Nilson Leitão filed a bill 10010/2018, which creates collective property eviction, a specific crime for invasion of urban or rural property, public or private.
“Today there is legal uncertainty for real estate owners, both in the countryside and in the city, who can have their property invaded at any time by movements that act pure political motivation. This instability hinders production, the recovery of the economy and delays the country, “he said in a statement.
There already exists in the Penal Code the general crime of possession foul, with penalty of 1 to 6 months of detention, characterized by the loss of possession of a property by the act of someone who seizes it by force. However, different types of acts, with different degrees of severity, can be framed in the same crime.
The bill creates the crime of collective possessory evasion because it is of greater gravity, with a sentence of 4 to 8 years imprisonment and a fine and extends the penalty in the case of individual invasion, that passes from 1 to 6 months of detention for 1 to 4 years in prison.
